Lifesparkz Bike Tours informs you about these terms, conditions and waiver during the process of booking and expect you to have read them through before the cycling tour / event.
The waiver is binding by your tacit consent, meaning that it is binding unless you notify Lifesparkz Bike Tours before the start of the tour / event that you do not approve.

As I design events and tours to suit your personal wishes, it is always best to contact me to confirm the availability, time, route, level and starting point for your tour well ahead of time.
In general I need a minimum of 5 working days in advance to organise a single day tour, 3 weeks to organise multiple days tours and a minimum of 2 month to organise events.
Booking / reservation (single day tours and multiple day tours for individuals and small groups)
You have booked a tour, when you have received confirmation from Lifesparkz Bike Tours that I have received payment of a deposit of 50% of the full price (or full payment) for the tour. The full amount must be paid at the day of one calendar month before a tour. This means that you must pay the full price in advance if you book a tour within a month before the tour date.
Booking / reservation (events with bigger groups)
You have booked an event, when you have received confirmation from Lifesparkz Bike Tours that I have received payment of a deposit of 25% of the full price (or full payment) for the tour. The full amount must be paid at the day of one calendar month before a tour. This means that you must pay the full price in advance if you book a tour within a month before the tour date.
Special conditions apply when you book accommodation or bike rental for a bigger group as a part of the cycling event. You receive the specific conditions that apply for the event in writing during our communication in the booking process.
Payment details
You can pay by bank wire or PayPal. Payment is only accepted in cash when we meet at the tour after special agreement. All prices and payments are in Euro.

The tour price includes
A tour guided by an experienced bike guide, which will follow a pre-designed route to locations as described in the tour descriptions.
The tour price excludes
Bike, helmet and other bike equipment (for road-bikes: I recommend that you bring a spare tube and pump) The guide will bring a multitool and tire levers.
Water/energydrinks/bars that the participant needs during the tour
Food/beverages that the participant may whish to buy at stops during the tour
Transportation back to start point if the participant wants to stop before the tour ends. Some bike rental shops provide a transportation service, if you have mechanical problems during the time that you rent their bike. Otherwise I advice you to pre-arrange with next-of-kin, who can pick you up by car, and always bring a telephone and cash/credit cards in case you need to return by train or we will need to call for a taxi-service to bring you back with your bike.
The above services can be included in a tour offer upon request.
Cancellation and refunds
Participant’s cancellation
Up until 6 weeks before the tour date - 90 percent refund
Up until 15 days before the tour date – 50 percent refund
Later cancellations - no refund
Special conditions apply for events that include accommodation, bike rental and other extra services.
Lifesparkz Bike Tours’ cancellation:
Lifesparkz Bike Tours may have to cancel a tour due to weather conditions. If I cancel a tour because of weather conditions, I will offer you to do the tour on another date. In case it is not possible for you to go on another day, I give you a full refund.
Force majeure: In the rare case of severe weather conditions such as hurricane, flooding, earthquake (natural disasters), or war, terrorist acts or other severe situations, where there is a security allert, Lifesparkz Bike Tours unfortunately cannot give a refund when cancelling a prepaid tour. I offer to rebook the date of a tour for no further cost.
Participant’s agreement of waiver and release with Lifesparkz Bike Tours
I hereby agree that:
Equipment
I acknowledge that I have the sole responsibility for my personal possessions and cycling equipment during the tour. I have the responsibility to provide a bike and a helmet which are fully functioning. I am also responsible of checking the equipment before the tour starts. I acknowledge that if a Lifesparkz Bike Tours’ guide performs any repairs or work on my bike or other equipment, Lifesparkz Bike Tours does not warrant that work nor offer any guarantee of any kind in respect of that work.
Helmets
Lifesparkz Bike Tours encourages you to wear a helmet at all times when cycling. In France there is no legal demand to wear a helmet for people above 12 years. In Spain there is a legal demand to wear a helmet when cycling out side of urban areas.
Rules and regulations
I agree to comply with all road rules and regulations, and all lawfull instructions and directions of Lifesparkz Bike Tours, its directors, contractors and volunteers (the Organiser) during the tour. If I fail to comply with the road rules and regulations, and instructions and/or directions of the Organiser, I will not be permitted to participate or continue to participate in the tour.

Physical condition
I realize that going on a cycling tour with Lifesparkz Bike Tours requires physical exertion and I represent that I am in sound medical condition capable of participating in the bicycle ride without risk to others or myself. I have no physical or medical impediments that would endanger others or myself.
I agree that I will use good judgment, be self-reliant and stop to request assistance from the tour guide if I am unsure of my ability to complete any segment of the tour safely.
Use of telephone or camera
I am solely responsible for the manner in which I ride the bike. I acknowledge that I will NOT use my telephone at any point while I am moving by bike during the tour due to the disruption it may cause to my concentration and the enjoyment of other participants. I understand that the use of phones and cameras is strictly limited to tour stops only and that it is illegal in France and Spain to carry a phone in my hand while cycling.
Risk
I acknowledge that cycling can be an inherently dangerous activity. I recognise that there are risks and hazards specifically associated with this activity. This includes the possibility of injury or death and loss and damage both to myself and my possessions. I therefore release the Organiser of any liability resulting from injury, death, loss or damage during the tour.
Injury or illness
Acknowledge that if I suffer any injury or illness during the tour, I agree that the Organiser may provide evacuation, first aid and/or medical treatment at my expense. My acceptance of these terms and conditions constitutes my consent to such evacuation, first aid and/or medical treatment.
Alcohol or any mind-alerting substance
Lifesparkz Bike Tours advises you to completely avoid consumption of alcohol or any mind-alerting substance (such as narcotics or some kinds of medicins) immediately before or during cycling. We refer to the French and Spanish laws of consuming alcohol while cycling, which rule that you can maximum have a 0,5 grammes of alcohol per one liter blood or 0,25 mg alcohol per liter air exhaled at a breathing test. They apply to motorists as well as cyclists.
I understand and acknowledge the dangers associated with the consumption of alcohol or any mind-alerting substance (such as narcotics or some kinds of medicines) before or during any cycling activity. I accept full responsibility for injury, loss or damage arising from consumption of alcohol or any mind-altering substance.
Photographs and videos of me
I grant permission to the Organiser to take (or cause others to take) photographs and videos of me during the tour, and to use the same for any purpose including but not limited to promoting, advertising and marketing. I acknowledge and agree that any such photographs and videos shall be the sole property of the Organiser and its assigns.
I can at any time before, during or after the tour ask the guide to NOT take any photo or video of me and that I do not want to have those taken shared on any media platform.
Waiver
For myself, my executors, administrators, heirs, next-of-kin, successors and assigns, I hereby:
(1) waive and release all claims I may have against the Organiser or any one or more of their executors, administrators, heirs, next-of-kin, successors and assigns including any or all claims for injury, loss or damages cuased by negligence of any of the above arising out of my participation in the tour.
(2) This includes any costs including legal fees that may be incurred as a result of such claims whether valid or nor; and indemnify and hold harmless the releases and each of them against any such claim that I or any one or more of my executors, administrators, heirs, next-of-kin, successors and assigns may have or assert and against any costs including legal fees with respect thereof
(3) acknowledge that if I were to assert a claim such claim would be subject to the exclusive jurisdiction of the laws of France.
